User Agreement for thaibuytrip.com (dated 01.09.2022)
Thaibuytrip (thaibuytrip.com) is a service for booking yachts and boats and purchasing tickets for boat trips, excursions and active sports online. We are a boat booking and ticketing agent in Thailand.
By making a boat reservation or buying an e-ticket on our website, you agree to all of the terms and conditions listed below, including the rules of conduct on board.
If the client does not agree to the terms of the user agreement, he is automatically not allowed to make boat reservations or buy e-tickets.
1. Basic notions
Organizer — a company which organizes tourist or entertainment services or events together with a boat company.
Customer (client) — a person booking a boat or purchasing an e-ticket through the Thaibuytrip service.
Thaibuytrip is an online e-ticket and boat rental store. The management company (website operator) is NEVATRIP LLP.
Payment System — is a system that synchronizes your checking account with our company's account. The system is a guarantor of cleanliness of the transaction between the bank of the client and NEVATRIP LLP.
Electronic ticket — an electronic document with an unique number displaying information for boarding. The ticket is sent to the client after the payment is made. This document, depending on the tour, must be provided at the pier ticket office or administrator at boarding in electronic form (on the screen of your phone or tablet) or in paper form.
Event — a complex of services for the organization of events on board, which may include excursions, catering, musical accompaniment and other services agreed upon with the client in advance.
2. Buying an electronic ticket
Our service does not perform preliminary reservation with the further purchase of electronic tickets at the pier or before the start of the tour or excursion.
You are assigned a seat based on the capacity of the boat and the number of seats on enclosed decks.
Electronic tickets are valid only for the tour, date and time indicated in the purchased ticket.
The cost of the trip on the website and at the pier may differ in accordance with the marketing policy of the company.
The information on the excursion pages (place, time, cost and other information) is valid only at the time of purchase.
Commission for refund of tickets at the initiative of the client
More than 72 hours before departure — 5% of the ticket price.
Less than 72 hours — 100% of the ticket price (tickets cannot be refunded).
More than 7 days before the trip — no fee refund. Less than 7 days before the trip — 50% commission of the ticket price.
Ticket refund and change rules
Tickets are refunded upon the customer's request via e-mail info@thaibuytrip.com not later than 72 hours before the departure time, indicated in the ticket. Request must be sent during working hours (from 14:00 to 23:00).
If the customer did not use the ticket and did not issue a refund 72 hours before the departure of the boat (the start of excursion), the ticket is not refunded.
If the trip is canceled due to technical or other conditions (which are not force majeure) that prevent the trip or excursion to the full extent, the client receives a refund.
Refunds are not made in cases of external bad weather (rain, thunderstorm, fog) or other uncomfortable conditions.
Refunds are not issued if the ticket was not used due to non-appearance/late arrival of the passenger.
Tickets are not refunded in case of change in excursion program.
Refund procedure
Refunds are issued upon written request to our e-mail info@thaibuytrip.com, stating the reason for the refund and attaching the e-ticket for which the refund is to be issued. The request should be sent during working hours (from 14:00 to 23:00).
The application for refund is processed within 24 hours upon receipt, after which we send a request to the payment system for a full or partial refund.
The process of refund by the bank takes up to 10 working days. Be careful, refunds are a withdrawal operation, so money can be refunded by the date of purchase.
If the funds have not been credited to your card within that period of time, check the card statement from which the purchase was made or contact your bank to request a refund.
3. Yacht charter and boat rental
Services are paid in the amount of 100% of the cost in advance of the event.
Payment is considered to be made after receiving 100% of the sum from the cost of ordered services to the organizer's bank account.
After the 100% payment the customer receives an electronic ticket which is used for boarding and a payment document.
Clients who have boarded the ship are obliged to follow the safety requirements, as well as to comply with the requirements of the ship's captain.
Boarding and disembarking of passengers takes place at a strictly scheduled time.
The number of passengers on board may not exceed the pre-agreed number.
In case of cancellation by the customer, the organizer refunds the previously paid amount within five banking days, counting from the date of receipt of written notification by e-mail info@thaibuytrip.comabout the cancellation of services. In this case the following fees are charged:
In case of cancellation more than 72 hours before the event, the organizer refunds the amount paid by the customer minus a penalty of 50% of the total cost of services.
In case of cancellation less than 72 hours before the event — 100% of the cost of services.
Postponement of the event to another date upon the client's initiative is possible at least 4 days before the event, provided there is a free vessel.
In case of canceling the event initiated by the organizer due to technical or other reasons a full refund, transfer of the cruise to another date or to another vessel of the same or higher class (by agreement with the customer) is provided.
If the event is canceled in case of force majeure, the organizer and the client are exempt from liability.
The organizer has the right to change the terms of this agreement, notifying the client by phone or other means of communication.
4. Privacy policy
We do not collect any personal data of your bank card. You give us only your phone number, e-mail address, name and the parameters necessary to rent a boat or book a ticket. This information is held by us and is necessary for identifying your booking, sending your ticket and communicating with you. Your contact information is used solely to transmit information about the trip or promotions.
Payment processing security is guaranteed by NEVATRIP LLP. All transactions with payment cards are made in accordance with the requirements of VISA International, MasterCard and other payment systems. During information transfer the special security technologies of online card payments are used; the data is processed on the secure high-tech server of the processing company.
5. Rules of conduct on board
Alcohol abuse and subsequent reckless behavior may result in a fine or termination of the charter without refund.
Throwing trash into the water is prohibited.
It is forbidden to take on board any items classified as dangerous or illegal (compressed gases, corrosive substances, weapons, explosives and flammable substances, drugs, radioactive materials, poisons, infectious materials, etc.).
Smoking is prohibited in all areas of the boat.
Children may not be left unattended.
Passengers in an alcoholic or other altered mental and physical condition may be excluded from the voyage by the crew if such condition or behaviour is not consistent with the safety of the vessel and may interfere with the necessary comfort of the other passengers. If for the above reasons the passenger is not allowed on board, the trip will not be rescheduled or refunded.
Pregnant women, children under one year of age and people over 70 are not allowed on the tours.
6. Liability for damages
Before boarding the hired vessel, the organizer reserves the right to charge the clients a security deposit, which will be used to compensate any damage or additional services rendered on board.
In case of damage to property, equipment or any other components of the hired vessel, the client is obliged to fully compensate for the damage caused.
Any fines incurred as a result of direct action or non-compliance by passengers will be paid by the customer.
The organizer is not responsible for any loss or additional expenses incurred as a result of death, accident, injury or illness.
